Policy Statement
The State Board of Community Colleges (SBCC) allows each college’s board of trustees to establish policies and procedures related to civil leave. Durham Technical Community College (Durham Tech) understands and supports employees’ responsibility and right to fulfill their civic duty.
Procedure
Civil leave with pay is granted to any full-time Durham Tech employee summoned by a judge to appear in court as a juror or witness. An employee who is a party (plaintiff or defendant) in a court procedure is not considered a witness; therefore, annual or compensatory leave must be used or the employee must take leave without pay for the purpose of attending court.
Civil leave covers only the specific time required by a summons. Employees requiring civil leave must submit an Employee Leave Request, with "Military/Court/Jury Duty" checked. A copy of the court summons must be submitted with the form. The Business Office also requires verification of the time taken as civil leave. Employees who are compensated for their involvement in a court or legal procedure may retain the compensation they received for fulfilling their civil duty.
